The Dutch government has announced that all maintenance obligations will be indexed by 6.2 % as of the 1st of January 2024.
Child maintenance and partner/ spousal maintenance are automatically indexed by law on a yearly basis in The Netherlands. The indexation is applicable to court orders as well as maintenance agreements. The automatic indexation can only be wiaved by either a written agreement between parties or a (new) court order. This is also the case if your original agreement does not contain any indexation clause.
The percentages for previous years:
Due to higher inflation, the index correction is a lot higher this year than in 2023.
If you did not index your maintenance in previous years extra maintenance may still be owing up to five years in arrears.
If your income has not risen with inflation or you have suffered a decrease in income, there may be grounds for adjustment of your maintenance.
